Swipe and Drive Promotion
TERMS AND CONDITIONS OF ENTRY


1. The “Swipe and Drive” promotion (“Promotion”) is brought to you by Coca-Cola Amatil (N.Z.) Limited (“CCA” or “Prize Provider”) and the Promoter. The Promoter is Subway Franchisee Advertising Fund Trust B.V. (SFAFT BV), care of Simplicity Australasia Ltd, Level 1, 14-22 Triton Drive, Rosedale, Auckland 0620. (“Promoter”).

2. This Promotion is open to permanent New Zealand residents aged 13 years and over. Employees (and their immediate families) of the Promoter, Franchise World Headquarters LLC (FWH), Doctor’s Associates Inc (DAI), Subway Real Estate Ltd, (“Promotion Entities”) Subway® franchisees and their employees, and any companies or agencies associated with the Promotion are ineligible to enter. If a winner is under the age of 18 years, their parent or guardian will be required to accept the awarded Main Prize, and the parent or guardian will be required to sign acceptance of the Terms and Conditions prior to claiming the Main Prize.

PROMOTION DATES

3. This Promotion opens at 12:00:00am on Monday, 08 June 2015 and closes at 11.59.59pm on Sunday, 12 July 2015 (“Promotion Period”). Entries received before or after the Promotion Period will not be accepted.

HOW TO ENTER

4. To take part in the Promotion, during the Promotion Period: 5. In addition, you will receive an automatic additional entry if your SUBCARD® is registered. To register a SUBCARD®, visit https://www.subway.co.nz/subcard-1 and follow the link to “Activate Card”. If your SUBCARD® is not registered at the time of the Qualifying Purchase, you will not receive an additional entry into the promotion and will forfeit the benefit of this automatic 2nd entry.

6. All successful entries will be entered into the daily draw, weekly draw and the main prize draw. Winning a prize from any one of these prize categories does not preclude a Winner from winning another prize from one of the other prize categories. Entrants have the chance to win prizes from any of the three prize categories (but only once for each category).

7. These Terms and Conditions are only applicable to in store purchases only and not online orders.

MAIN PRIZE

8. At the end of the Promotion Period, one (1) winner will be drawn to win a 2015 Ford Focus Sport Automatic 2.0 Litre Hatch car (the Main Prize), black in colour (valued at $42,340+ORC).

10. Any additional costs not stated in these Terms and Conditions, including (but not limited to) insurance, obtaining an appropriate license, maintenance costs and additional optional extras, are the responsibility of the winner.
11. There is one (1) Main Prize to be won.

12. Main Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of the Prize.

13. The Main Prize winner must collect the Main Prize in person from the nearest authorized Ford dealer promptly after being notified (and by no later than 28 days of notification that the Main Prize is available for delivery) and agrees to sign all documents required to register the vehicle in their name on or prior to collection. The Promoter recommends that the winner effects adequate motor vehicle insurance for the vehicle from the time of collection.

WEEKLY PRIZES

14. On Monday each week during the Promotion Period (starting on 15 June 2015), there will be a draw to win the following prizes (each a “Weekly Prize”):

17. There are 1925 Daily Prizes to be won during the Promotion Period.

PRIZE DRAWS

18. Daily Prizes, Weekly Prizes and the Main Prize are together referred to as Prizes (“Prizes”) in these Terms and Conditions.

19. The prize draw for the Main Prize will take place at 12.00PM on 20 July 2015 by the Promoter at the premises of Simplicity Australasia Ltd, Level 1, 14-22 Triton Drive, Rosedale, Auckland, New Zealand (Main Prize Draw).

20. The Promoter will contact the Main Prize winner by phone or email as soon as possible after the Main Prize Draw has taken place using the contact details provided by the winner's entry. If the Main Prize winner cannot be contacted by the Promoter by phone after three (3) consecutive attempts or is not able to satisfy these Terms and Conditions or forfeits or fails to claim the Main Prize by contacting the Promoter by email or phone by 5.00PM on 27 July 2015, they will be deemed to have forfeited their entitlement to the Main Prize. In the event that the Main Prize winner forfeits his/her prize, an alternative Main Prize winner will be drawn at the Promoter’s discretion.

21. The Prize draws will be randomly drawn from all valid entries received during the Promotion Period.

22. The Weekly Prizes will be drawn weekly each Monday for the duration of the Promotion from all eligible entries submitted the previous week before and on the following dates: Monday June 15, 22, 29, July 6 and 13, 2015. The winner will be notified via the e-mail address or the mobile number registered in the winner’s account. The Promoter is not responsible for any undelivered e-mails due to the winner’s SPAM filters or e-mail settings. For the avoidance of doubt, each Weekly Prize draw will use entries received between 12:00:00am on Monday and 11:59:59pm on Sunday each week of the Promotion Period but the Qualifying Purchase/s can be from any week during the Promotion Period. The qualifying entry can only be used for one (1) weekly draw. Prizes not claimed within 14 days of the notification being sent will be forfeited and may be redrawn.

23. Each day during the Promotion Period, one entry will be drawn from all eligible entries submitted the previous day. SUBCARD® $5 Reward Dollars, 600ml Coca-Cola range drinks and cookie winners will be notified via the e-mail address registered in the winner’s account. The Promoter is not responsible for any undelivered e-mails due to the winner’s SPAM filters or e-mail settings. Prizes not claimed within 14 days of the notification being sent will be forfeited and may be redrawn. For the avoidance of doubt, each Daily Prize draw will use entries received between 12:00:00am and 11.59.59 pm each day of the Promotion Period but the Qualifying Purchase/s can be from any day during the Promotion Period. The qualifying entry can only be used for one (1) daily draw.

GENERAL

24. Information on how to enter and prizes forms part of these Terms and Conditions.

25. By entering this Promotion, you accept these Terms and Conditions.

26. All Prizes must be taken as offered and cannot be varied. Prizes cannot be redeemed for cash, exchanged or transferred.

27. Entry into this promotion authorises the Promoter to release any winner’s name, phone number(s) and email address(s) to their agencies in order to contact and verify the winner.

28. The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant for tampering with the entry process or who enters the promotion otherwise than in accordance with these Terms and Conditions.

29. The Promoter and Promotion Entities are not responsible for any problems or technical malfunction of any telephone network or lines, servers or providers, or any combination thereof. Nor is it responsible for any incorrect or inaccurate information caused by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission communications line failure, theft or destruction or unauthorised access to or alteration of entries.

30. If for any reason this Promotion is not capable of running as planned due to reasons beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to, in its sole discretion, modify or cancel this Promotion, or substitute prizes.

31. All entries are deemed to be received at the time of receipt by the Promoter’s database and NOT at time of transmission by the entrant. Records of the Promoter are final and conclusive as to time of receipt.

32. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings.

33. Winners may be required to show proof of identity and sign a declaration that they are the winner prior to being awarded a Prize.

34. In the event of a dispute or need for clarification, the Promoter’s decision is final and no correspondence will be entered into.

35. In the event that any Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Prize of equal or greater value.

36. To the fullest extent permitted by law, the Promoter, SUBWAY® restaurants, Subway International B.V, Doctor’s Associates Inc., Franchise World Headquarters, LLC, SUBWAY® Development Agents and their related companies (as defined in the Companies Act 1993), employees and agents are not liable for any direct or indirect loss, damage, or injury by any person whatsoever, arising from participating in this Promotion or in connection with winning (or not winning) a prize.

37. All entries become the property of the Promoter. It is a condition of entry into the Promotion that the prize winners agree to participate in publicity generated by the Promoter (or the Promoter’s marketing partners) and agrees to the use of their names and photographs for any promotional purposes for an undisclosed period of time.

38. The Promoter will retain your information for the purposes of this promotion. The Promoter will only retain your personal information to send you updates on future SUBWAY® offers if you consent to it doing so. 39. The Promoter reserves the right to change any of the terms and conditions applying to this Promotion or to modify, terminate, suspend or reschedule this Promotion due to an event beyond the Promoter's reasonable control. Any changes to the terms and conditions applying to this Promotion will be updated in the terms and conditions on the Promoter's website (www.subway.co.nz/swipeanddrive)

40. Each exclusion or limitation of liability in these Terms and Conditions also applies to the owners and operators of SUBWAY® restaurants, Subway International B.V., SFAFT B.V., Doctor’s Associates Inc., Franchise World Headquarters, LLC, SUBWAY® Development Agents and their related companies (as defined in the Companies Act 1993), employees and agents.

41. PRIVACY / USE OF PERSONAL INFORMATION: Please note, if Eligible Entrant, is considered a minor in your jurisdiction of residence (generally, a minor is under eighteen (18) years of age), Eligible Entrant must first get their parent/legal guardian's permission before participating in the “SWIPE AND DRIVE PROMOTION”. By participating, in the “SWIPE AND DRIVE PROMOTION”, Eligible Entrant (if a minor, Eligible Entrants parent/legal guardian) agrees to the “SWIPE AND DRIVE PROMOTION” Privacy Statement and Official Rules located at: www.subway.co.nz/swipeanddrive

The Administrator and/or Promoter may gather Personal Information provided by Eligible Entrants online for the purposes of conducting and managing this Promotion and may, for this purpose, disclose such Personal Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, and if required, to any regulatory authorities. Personal Information may include, but is not limited to: name (full name or first initial and last name), maiden name, nickname, email address, home address, home postal code, home telephone number, mobile telephone number, date of birth, photographic images (especially of face or other identifying characteristics, such as, but not limited to: eye, skin, and hair color, facial features, personal marks such as, but not limited to: tattoos, birthmarks, moles, and scars, as well as, video and voice recordings.. Personal Information is only collected when volunteered by an Eligible Entrant, at the time Eligible Entrant enters the “SWIPE AND DRIVE PROMOTION”. If Eligible Entrant does not provide Administrator and/or Promoter the requested Personal Information required to enter the “SWIPE AND DRIVE PROMOTION”, Eligible Entrant will not be able to participate in the “SWIPE AND DRIVE PROMOTION”. By participating in the “SWIPE AND DRIVE PROMOTION” located at: www.subway.co.nz/swipeanddrive, the Administrator and Promoter, feel that Eligible Entrant should know how the Administrator and/or Promoter may collect, use, share, and protect Eligible Entrant's Personal Information. The “SWIPE AND DRIVE PROMOTION” Privacy Statement located at: www.subway.co.nz/swipeanddrive, describes, among other things, the types of Personal Information that may be collected from Eligible Entrant, how the Administrator and/or Promoter may use Eligible Entrant's Personal Information, when the Administrator and/or Promoter may share Eligible Entrant's Personal Information, who Eligible Entrant's Personal Information may be shared with, how the Administrator and/or Promoter protect Eligible Entrant's Personal Information when Eligible Entrant enters the Promotion, how Eligible Entrant may opt-out, access, update, or correct Personal Information Eligible Entrant provided Administrator and/or Promoter upon entering the Promotion, how and/or who Eligible Entrant may complain to if Administrator and/or Promoter breach any applicable law regarding the Promotion, and how Administrator and/or Promoter may deal with such complaints. The “SWIPE AND DRIVE PROMOTION”, Privacy Statement also applies to any Personal Information Eligible Entrants may provide to Administrator and/or Promoter offline, such as, any Personal Information the Eligible Entrant may provide to the Administrator and/or Promoter at a live event, during verification procedures, or any other instances in which Administrator and/or Promoter may collect Personal Information from Eligible Entrants offline, solely regarding the “SWIPE AND DRIVE PROMOTION”. Upon entering the, the Promoter, “SWIPE AND DRIVE PROMOTION”, may ask Eligible Entrant to Opt-In (which requires Eligible Entrant’s express consent), to receive specifically requested opt-in information or materials by Eligible Entrant, such as, but not limited to: coupons, newsletters, informational materials, marketing communications, or other special sweepstakes, promotions, etc., or other offers, from “SWIPE AND DRIVE PROMOTION”, its affiliates within, the FAF Group and/or the SUBWAY® Group, or third-party service provider, Customer Portfolios LLC (“CP”), located in Boston, Massachusetts, United States of America (USA). If Eligible Entrant does not specifically check the Opt-In box, Eligible Entrant “SWIPE AND DRIVE PROMOTION”’s role in the “SWIPE AND DRIVE PROMOTION” is limited to promoting the Promotion, draft, bond, and register the Terms and Conditions for the Promotion as required by law, and is one of the Prize Providers of the “SWIPE AND DRIVE PROMOTION”.
